Legal charges for Probate Services & Administration of Estates

The administration of an estate includes applying for a Grant of Probate or Letters of Administration, collecting in and distributing the assets of the estate to the beneficiaries as set out in the Will of the deceased or under the Intestacy Rules (if the person passed away with no Will).

Legal costs in respect of the administration of the estate are 2.5% plus VAT and disbursements. If there is a property to sell on behalf of the estate, this fee will include any conveyancing charges.

We shall of course advise you in advance should these costs need to increase.

Our charges include:

  • Attending upon Executor and receiving instructions
  • Receiving documentation relating to the assets and going through the same; scheduling assets and debts
    where appropriate 
  • Writing to authorities and institutions to confirm the extent of assets and ascertaining values as at 
    date of death.  Receiving and checking forms
  • Liaising with Funeral Home and notifying as to delayed payment. 
  • Drafting Inland Revenue Account and checking the same in readiness for signature by Executor.  
    Thereafter arranging signing and swearing by Executor 
  • Drafting Oath for Executor and checking the same for signature by Executor
  • Submitting application for Grant of Representation and Inland Revenue Account to Probate Court and 
    applying for Grant of Representation 
  • Dealing with requisition of Probate Court
  • Receiving Grant of Representation and checking the same 
  • Registering Grant of Representation where required together with necessary forms relating to the release of funds
  • Settlement of the funeral account 
  • Receiving and checking balance of funds dues to the estate, banking the same and entering into Cash Account
  • Preparation and perusal of stock transfer forms
  • Transfer of shares to beneficiary 
  • Preparing Estate Cash Account and reconciling same with ledger and/or bank statements.  Submitting to 
    Executor for approval and signature and dispatching all copies as required.
  • Indexing and filing original Grant of Representation in vaults or as required
  • Liaising with and dealing with requisitions of HMRC and probate registry as appropriate 
  • Preparing ‘Executor Accounts’ in accordance with estate administration requirements

Disbursements

All fees quoted above are exclusive of disbursements, expenses and third party costs incurred e.g. estate agents, valuation fees which will be charged in addition to the fees quoted above

This is an indication of charges on the basis of details presently known and on the assumption that the transaction will not prove to be substantially more complex or time-consuming than expected.

If the matter does not proceed to completion, work done and payments made up to that point remain chargeable. VAT and other payments may be subject to alteration. In addition you may have to pay other parties (e.g. your Surveyor, Management Company fee in relation to leasehold transactions).

Should you wish to complete your transactions in less than ten working days between exchange and completion for every day less than the ten working days an expedition fee of £20.00 plus VAT per day may be payable. This sum is payable in addition to the fees outlined above.

If the property is Leasehold, we are also required to provide a Landlords Information pack and there will be an additional disbursement for this. We are unable to give an exact price as all Landlords charge differently.

                                     Complaints Procedure

We have eight weeks to consider your complaint. If we have not addressed it within this time, you may complain to the Legal Ombudsman.

If you are not satisfied with our handling of your complaint you can ask the Legal Ombudsman to consider the complaint. Normally, you will need to bring a complaint to the Legal Ombudsman within six months of receiving a final written response from us about your complaint or within six years of the act or omission about which you are complaining occurring (or if outside of this period, within three years of when you should reasonably have been aware of it).

You should also be aware that, when your complaint relates to a bill, the Legal Ombudsman will not consider your complaint while your bill is being assessed by a court.

A complainant to the Legal Ombudsman must be one of the following:

  1. An individual;
  2. A micro-enterprise as defined in European Recommendation 2003/361/EC of 6 May 2003 (broadly, an enterprise with fewer than 10 staff and a turnover or balance sheet value not exceeding £2 million);
  3. A charity with an annual income less than £1 million;
